We are pausing the mandatory collection and reporting of information related to the FinCEN Anti-Money Laundering Rule covering residential transactions involving cash and certain types of business entities.
As background, last Thursday, a federal court in Texas ruled that the current implementation of the FinCEN Anti-Money Laundering Rule was beyond the scope of authority for the agency. Then on Friday, the U.S. Department of Treasury (FinCEN) declared: "In light of a federal court decision, reporting persons are not currently required to file real estate reports with FinCEN and are not subject to liability if they fail to do so while the order remains in force."
While this plays out in court, we will offer our clients the option to collect the data and hold it pending resolution. We don’t want transactions delayed if the rule is upheld. It is likely we will have some direction in a month or so. We are monitoring developments and will keep you informed of any changes that may impact your transaction.
